HS Code for Flexible Packaging: Classification Guide for Importers
Flat film takes heading 3920 by polymer and finished pouches take heading 3923, while laminated film is tested under heading 3921. This guide works through the made-up test, polymer lines and national extensions.
Short answer
Flexible packaging has no single HS code: flat, unlaminated plastic film takes heading 3920 by polymer, a finished bag or pouch takes heading 3923, and a laminated flat film is tested under heading 3921. Only the first six digits are shared worldwide, so confirm the full national code for the exact article and destination before filing.

Key takeaways
Flat, unlaminated plastic film takes heading 3920 by polymer, at 3920.10 for polymers of ethylene and 3920.20 for polymers of propylene, while a finished bag or pouch takes heading 3923.
The made-up test decides between film and pouch: film cut into rectangles but not further worked stays in 3920 or 3921, while film sealed into a bag or pouch becomes a 3923 article.
A laminated film fails heading 3920, which covers only film that is not reinforced, laminated, supported or similarly combined, and is tested under heading 3921.
Inside a Chapter 39 heading, copolymers and blends follow the comonomer unit that predominates by weight, and a subheading naming a polymer with the prefix poly requires 95 percent or more by weight.
Only the first six digits are shared worldwide: the EU extends to eight digits and the United States and United Kingdom to ten, so confirm the full national code per article and destination.
If you import pouches, bags, wraps or lidding film from Bangladesh, the hs code for flexible packaging is decided by what the pack itself is, not by the food, powder or liquid inside it. A roll of printed film and a finished stand-up pouch can leave the same factory on the same day and still take different headings. The Harmonized System is a multipurpose international product nomenclature developed by the World Customs Organization (WCO), comprising more than 5,000 commodity groups, each identified by a six-digit code, and used by more than 200 countries and economies as a basis for their customs tariffs.1
Quick answer: the indicative hs code for flexible packaging (with verify note)
There is no single code for flexible packaging. Flat, unmade film sits in heading 3920, a finished bag or pouch sits in heading 3923, and a laminated film that is no longer a plain sheet is tested under heading 3921. Treat every line below as indicative and confirm the full national code before filing.
Article as shipped | Indicative heading | Why |
|---|---|---|
Flat film, sheet or strip, not self-adhesive, not laminated or combined | 3920, by polymer: 3920.10 for ethylene, 3920.20 for propylene, 3920.62 for poly(ethylene terephthalate) | Heading 3920 covers flat plastic film that is non-cellular and not reinforced, laminated, supported or similarly combined2 |
Laminated or otherwise combined flat film | Heading 3921, other flat film of plastics | A laminated film fails the 3920 test, which covers only film that is not reinforced, laminated, supported or similarly combined2 |
Finished sacks and bags, including pouches | 3923.21 for ethylene, 3923.29 for other plastics | Heading 3923 covers articles for the conveyance or packing of goods, of plastics3 |
Other finished packing articles that fit no named 3923 line | 3923.90 | Heading 3923 ends with an "other" line for packing articles not elsewhere specified3 |
The United States schedule confirms the same split: sacks and bags of polymers of ethylene sit at 3923.21.00, sacks and bags of other plastics at 3923.29.00, and other packing articles at 3923.90.00.4 The United Kingdom tariff lists the same structure at ten digits, with sacks and bags of polymers of ethylene at 3923 2100 00 and sacks and bags of other plastics under 3923 29.5 Read the code for the exact article you are shipping, not for the product family on the purchase order.
How HS codes are structured (2-4-6 digits)
The Harmonized System organises its approximately 5,000 six-digit product categories in a hierarchy of sections, chapters at two digits, headings at four digits and subheadings at six digits.6 Countries then subdivide the six-digit categories further, and the Combined Nomenclature of the European Union uses eight-digit codes.6 The current version is HS 2022.6

For flexible packaging, the path runs Chapter 39 (plastics and articles thereof), then heading 3920 for flat film, heading 3921 for other flat film, or heading 3923 for finished packing articles, then a six-digit subheading by polymer or article type, then the national extension. Only the first six digits are shared worldwide.
Factors that decide the code for flexible packaging
The made-up test comes first. In headings 3920 and 3921, "plates, sheets, film, foil and strip" means material that is uncut or cut into rectangles, but not further worked, even if cutting it into rectangles makes it an article ready for use.4 A roll of film, and film cut into rectangular sheets, stays in 3920 or 3921. The moment the film is sealed, gusseted or otherwise formed into a bag, pouch or other container, it is a made-up article for the conveyance or packing of goods, and heading 3923 takes over. Printing alone does not change this: the same note covers film whether or not it is printed.4
Polymer decides the six-digit line. Inside heading 3920, the subheadings run by polymer: 3920.10 for ethylene, 3920.20 for propylene, 3920.30 for styrene, and 3920.62 for poly(ethylene terephthalate), among others.2 Inside heading 3923, the bag lines split the same way: polymers of ethylene at 3923.21 and other plastics at 3923.29.3 A polypropylene pouch and a polyethylene pouch therefore take different lines even when they look identical.
Blends follow the predominant monomer. Within a heading of Chapter 39, copolymers and polymer blends are classified by the comonomer unit that predominates by weight, and where a subheading names a polymer with the prefix "poly", the named monomer units taken together must contribute 95 percent or more by weight.4 Record the composition by weight for each film structure, since the layer percentages decide the line.
Laminates leave heading 3920. Heading 3920 is limited to film that is not reinforced, laminated, supported or similarly combined.2 A multi-layer structure in which plastic film is laminated to another plastic layer, to aluminium foil or to paper therefore fails the 3920 description and is tested under heading 3921, described as plastic plates, sheets, film, foil and strip not elsewhere specified in Chapter 39.7 Do not file a laminated film under 3920 because its outer layer is polyethylene, and do not file it under 3923 while it is still flat film: it becomes a 3923 article only once it is made up into a pouch or bag.
Bags, pouches and other articles are not interchangeable inside 3923. Sacks and bags, including cones, take 3923.21 or 3923.29 by polymer.3 A finished packing article that is not a sack or bag, a box, a bottle or a closure takes the residual line 3923.90.3 Closures have their own line: stoppers, lids, caps and other closures sit at 3923.50.3 A cap shipped separately is not part of the pouch code.
The contents do not set the code. Heading 3923 covers articles for the conveyance or packing of goods, whatever goods they will carry.3 The broker needs form, layers, polymer percentages and seals, not the brand or the filling line.
National codes: US HTS, EU CN/TARIC, UK commodity code
United States: HTS, ten digits. The United States schedule carries the six-digit lines to ten digits with statistical suffixes. Under 3923.21.00, the schedule separates reclosable bags with an integral extruded closure from other bags, and within each group it separates sizes and polyethylene retail carrier bags with handles from other bags.4 A zip pouch and a plain open-top bag can therefore carry different ten-digit lines inside the same six-digit subheading.
European Union: CN at eight digits, TARIC for measures. The Combined Nomenclature integrates the HS and adds EU subdivisions, producing eight-digit codes.6 The eight-digit line is the code the entry is made under, and TARIC carries the measures that apply on the entry date.
United Kingdom: commodity code. The United Kingdom builds its commodity code on the same first six digits with its own extension. For heading 3923, it lists sacks and bags of polymers of ethylene at 3923 2100 00, sacks and bags of other plastics at 3923 2910 00 for poly(vinyl chloride) and 3923 2990 00 for other plastics, and other packing articles at 3923 9000 00.5
How to confirm the code officially
Write a precise description: flat film or finished article, each layer and its polymer, layer percentages by weight, whether the film is laminated, pouch form and seal type, and dimensions.
Start from the official tariff for the destination: the USITC Harmonized Tariff Schedule, TARIC, or the United Kingdom Trade Tariff, and read the heading text and the Chapter 39 notes.
Check published rulings for similar articles. For the United States, the USITC advises traders to use the Customs Rulings Online Search Service (CROSS), because the correct classification of many items can be found there.8
For a borderline article, such as a laminated film whose layers could point to more than one heading, apply for a binding decision before you ship. In the European Union, a Binding Tariff Information application needs a separate application for each type of product and a detailed description.9 In the United Kingdom, a legally binding decision is generally valid for 3 years, through an Advance Tariff Ruling.10 In the United States, if the merchandise is not described in any ruling on CROSS, you may request a binding ruling from Customs and Border Protection.8
Give your broker the description and the confirmed code for each article, and use the same codes throughout the entry, invoice and packing list.
Common classification mistakes
Filing a pouch as film. A sealed pouch is a made-up packing article, not a sheet of film, even though it was film before sealing.
Filing film as a pouch. A roll of printed film that the buyer will form, fill and seal is still flat film at shipment.
Filing a laminate under 3920. Heading 3920 covers only film that is not reinforced, laminated, supported or similarly combined.2 A laminated structure needs the heading 3921 test first.
Filing by trade name instead of polymer. The 3920 and 3923 lines run by polymer, not by brand. Without layer percentages by weight, the blend rule cannot be applied and the line is a guess.
Copying another country's extension. Only the first six digits are harmonised.6 A United States ten-digit suffix, an EU eight-digit line and a United Kingdom ten-digit code for the same pouch will differ.
Filing every plastic pack under 3923.90. The residual line is for packing articles that fit no named line in the heading.3 A sack or bag belongs at 3923.21 or 3923.29 first.
Related duties and documents
This guide states no duty rates: the code decides which duty line customs applies, and a rate on a polyethylene bag line does not carry to a polypropylene film line. Read the rate beside your confirmed code for your origin and entry date, and check what proof of origin a preference claim requires. Keep the film specification, layer composition by weight, pouch drawings or samples, confirmed codes and any binding decision together in the shipment file, with film rolls and finished pouches as separate invoice lines.
FAQs
What is the HS code for flexible packaging?
There is no single code. Flat, unlaminated plastic film takes heading 3920 by polymer, at 3920.10 for ethylene or 3920.20 for propylene.2 A finished bag or pouch takes heading 3923, at 3923.21 for ethylene or 3923.29 for other plastics.3 A laminated flat film is tested under heading 3921.7
Is the HS code the same in every country?
Only the first six digits are harmonised. Beyond six digits, each country adds its own lines: eight digits in the EU Combined Nomenclature,6 and ten digits in the United States, where the 3923 lines split further by closure and bag type.4 The United Kingdom likewise extends the six digits to ten.5
How do I confirm the correct code?
Describe each article precisely, read the heading text and chapter notes in the destination tariff, and check published rulings, such as CROSS for the United States.8 For a borderline article, apply for a binding decision before shipping: a BTI in the European Union,9 an Advance Tariff Ruling in the United Kingdom,10 or a CBP ruling in the United States.8
What happens if I use the wrong code?
Duty, licensing and quota treatment are worked out from the code on the declaration, so a wrong code brings the wrong treatment. Taking a binding decision in advance helps you calculate the duties and restrictions that will apply.10
